Federal charges are much different than Washington state level crimes. If you have been charged with a federal crime, your case will process through federal criminal court system. There are a different set of procedures and you will be facing a federal prosecutor, who are normally highly experienced and they have a reputation of aggressive tactics to obtain a conviction.

Your case proceed through the Eastern District of Washington or the Western District of Washington. The Western District courthouses are in Seattle and Tacoma. If you were to file an appeal for a conviction or sentence, your case be handled at the U.S. Court of Appeals for the Ninth Circuit.

How You Could Be Charged With a Federal Crime

There are a variety of circumstances where you could face federal criminal charges, rather than a local Washington state level crime, including:

  • You were accused of violation of a federal statute, such as regulations from the the Internal Revenue Service (IRS) or Homeland Security
  • The alleged criminal behavior occurred on any type of federal property, such as national parks
  • You were accused of a crime that crossed states lines, such as online criminal conduct
  • Alleged criminal activity investigated by federal law enforcement agencies, such as the Drug Enforcement Administration (DEA), Federal Bureau of Investigations (FBI), of the Department of Justice (DEJ).

Federal Court Process

If you have been accused of a felony level crime,  federal prosecutors will convene a grand jury where they present evidence and oral arguments on the reasons why you should face criminal charges. These proceedings are held privately and all statements are sealed. You will not attend and if the jurors believe there is sufficient evidence, there will be an indictment and a warrant for your arrest.

You will have to go to your arraignment before a magistrate judge where you will be told of the charges against you, the right to an attorney, and conditions for release from jail. You also enter your initial plea of guilty or not guilty and you may have to obtain a bail bond. If you can't post bail, you will be remanded to the U.S. Marshal's and stay in custody until trial.

After arraignment, your federal criminal defense lawyer will obtain discovery and then start preparing your defense. In many cases, this is where the plea bargaining process begins. If no agreement is reached, your lawyer will participate in a preliminary hearing where the prosecutor shows their evidence can call witnesses. You attorney will be able to cross examine. Next, you lawyer will prepare for trail and start pre-trial motions and conferences. If you don't accept a plea agreement, then your federal crimes lawyer will present your defense at trial.
