DRUG CULTIVATION CHARGES

Drug cultivation laws make it a crime for anyone to grow, produce, and possess certain plants and other naturally occurring elements used in the production of unlawful controlled substances.  Furthermore, they also make it a crime to produce illegal controlled substances, which require use of certain chemicals and laboratory equipment in their production. Punishments vary according to the type of drug and the amount produced.  Under 21 U.S.C. ยง 841 it is a crime for any person to knowingly or intentionally manufacture, distribute or possess a controlled substance.  There are generally three ranges of punishment depending on the kind of drug and the quantity of the substance.  The different levels of punishment are (1) mandatory minimum of ten years to life sentence in prison; (2) mandatory minimum of five years to forty years sentence in prison; or (3) a sentence of zero to twenty years in prison.  While drug cultivation usually involves the actual creating/growing of any illegal substance, an individual may also be charged with a federal crime if found with chemicals used in drug manufacturing or apparatuses related to drug cultivation or use.
